Unmarried couples to get stronger legal rights

The Government has announced plans to strengthen the rights of unmarried couples when relationships break down, which could represent one of the most significant changes in this area of law for many years.
At present, many people are surprised to learn that living together does not give them the same legal rights as marriage or civil partnership. When unmarried couples separate, disputes about the family home and finances are often dealt with through property law rather than family law.
If these proposals become law, family law and property claims are likely to become more closely linked than ever before.
The proposals are still at consultation stage, but they are a reminder of just how important it is for cohabiting couples to understand their legal position. The idea of a “common law marriage” remains one of the most common misconceptions we encounter.
